TERMS & CONDITIONS
BY PURCHASING A SPA WEEK MEDIA GROUP, LTD. ("SWMG") GIFT CARD/ CERTIFICATE, YOU ("YOU" OR "CONSUMER") CONFIRM THAT YOU UNDERSTAND, AGREE TO, AND ACCEPT THE FOLLOWING TERMS AND CONDITIONS:
SWMG Gift Cards/ Certificates may only be redeemed at spas/ salons participating in SWMG's Gift Card Program (the "Participating Spas/ Salons"). A list of the Participating Spas/ Salons can be found in the Gift Card Directory located on www.spaweek.com. SWMG shall not be responsible for any reservations/ appointments that You book at spas/ salons that are not Participating Spas/ Salons.
SWMG Gift Cards/ Certificates have no expiration date.
SWMG Gift Card/ Certificates are non-refundable.
SWMG Gift Cards/ Certificates are transferable. However, any unauthorized resale of a SWMG Gift Card/ Certificate shall invalidate the SWMG Gift Card/ Certificate.
At the sole discretion of Participating Spas/ Salons, You may not be able to use a SWMG Gift Card/ Certificate during a Spring or Fall SWMG SPA WEEK Event. You must state Your desire to use a SWMG Gift Card/ Certificate when making a reservation/ appointment at a Participating Spa/ Salon.
SWMG is not responsible for lost, stolen, or mutilated SWMG Gift Cards/ Certificates, and shall not replace lost, stolen, or mutilated SWMG Gift Cards/ Certificates. A SWMG Gift Card/ Certificate should be treated the same as cash.
If the face value of a SWMG Gift Card/ Certificate is greater than the amount due from You to a Participating Spa/ Salon, the Participating Spa/ Salon shall issue You credit at the Participating Spa/ Salon; no balance or credit shall remain on the SWMG Gift Card/ Certificate. No portion of a SWMG Gift Card/ Certificate may be redeemed by You for cash; SWMG Gift Cards/ Certificates have a cash value of $0.0001 (USD).
The face value of a SWMG Gift Card/ Certificate is in US Dollars.
You must surrender a SWMG Gift Card/ Certificate to a Participating Spa/ Salon when You redeem the SWMG Gift Card/ Certificate at the Participating Spa/ Salon.
SWMG is an independent company and is not affiliated with or related to, in any way, any Participating Spa/ Salon.
SWMG does not make any representation or warranty, of any kind or nature, related to any good, service, and/ or treatment that You may receive in connection with Your use and redemption of a SWMG Gift Card/ Certificate.
SWMG (including, without limitation, its officers, directors, employees, agents, affiliates, and permitted assigns) shall not be liable to You for any and all claims or actions (whether or not groundless), liabilities, damages, costs and expenses (including, without limitation, court costs and reasonable attorneys’ fees), arising out of or in connection with (i) any negligent act or omission or willful misconduct of a Participating Spa/ Salon, or its directors, officers, employees, agents, or representatives; (ii) the provision of services, treatments, and/ or products, or failure to provide services, treatments, and/ or products, by a Participating Spa/ Salon, or an agent or representative of a Participating Spa/ Salon, to You; and (iii) any action brought by or on behalf of You relating to a Participating Spa/ Salon’s wrongful refusal to accept a valid SWMG Gift Card/ Certificate as payment for services, treatments, and/ or products.
All disputes arising between You and SWMG, shall be governed, construed, and enforced in accordance with the laws of the State of New York, without regard to choice of law provisions. You irrevocably consent to the exclusive jurisdiction of the federal and state courts in New York County with respect to any matter relating hereto, and hereby waive the defense of forum non conveniens to any such action.
SWMG shall be excused from liability for any failure to perform any obligations stated herein where such failure results from delays caused by acts of God, fires, floods, strikes, work stoppages, controls or regulations of federal, states, or local governments, or other causes beyond its reasonable control.
SWMG reserves the right to modify these Terms and Conditions without prior notice.
