Wellness Media Group, LLC ("WMG") is a wholly owned subsidiary of Spa Week Media Group, Ltd. ("SWMG").

BY PURCHASING, USING OR ACCEPTING A SPA & WELLNESS GIFT CARD/ EGIFT CARD BY SPA WEEK, THROUGH WMG ("THE ISSUER"), YOU ("YOU" OR "CONSUMER") CONFIRM THAT YOU UNDERSTAND, AGREE TO, AND ACCEPT THE FOLLOWING TERMS AND CONDITIONS:

WMG Gift Cards/ eGift Cards may only be redeemed at Spas/ Wellness Facilities participating in WMG's Gift Card Program (the "Participating Spas/ Wellness Facilities"). A list of the Participating Spas/ Wellness Facilities can be found in the Directory located on www.spaweek.com. WMG shall not be responsible for any reservations/ appointments that You book at spas/ wellness facilities that are not Participating Spas/ Wellness Facilities.

WMG Gift Cards/ eGift Cards that have been purchased, as well as the underlying funds, have no expiration date and are not subject to any dormancy, inactivity, service, or other fees.

WMG Gift Cards that have been given away as promotional cards have an expiration date.

WMG Gift Card/ eGift Cards are non-refundable.

WMG Gift Cards/ eGift Cards are transferable. However, any unauthorized resale of a WMG Gift Card/ eGift Card shall invalidate the WMG Gift Card/ eGift Card.

At the sole discretion of Participating Spas/ Wellness Facilities, You may not be able to use a WMG Gift Card/ eGift Card during a Spring or Fall SWMG SPA WEEK® Event. You must state Your desire to use a WMG Gift Card/ eGift Card when making a reservation/ appointment at a Participating Spa/ Wellness Facility.

WMG is not responsible for lost, stolen, or damaged WMG Gift Cards/ eGift Cards, and shall not replace lost, stolen, or damaged WMG Gift Cards/ eGift Cards. A WMG Gift Card/ eGift Card should be treated the same as cash.

Gift Cards/ eGift Cards – Amount can vary from $10 through $500 and is fixed at time of purchase. Usable up to balance to buy goods and/or services only at Participating Spas & Wellness Facilities listed at spaweek.com. If the value of a Gift Card is greater than the amount due from You to a Participating Facility, the Facility shall only deduct the amount for the service/ product purchased at that time. Remaining balance (if any) shall remain on card for future use. Gift Cards are not refillable. Not redeemable for cash in New Jersey, or for cash in any other state unless the state requires cash redemption. Not a credit or debit card. Safeguard the card. It will not be replaced or replenished if lost, stolen or used without authorization. WMG is the card issuer and sole obligor to card owner. WMG may delegate its issuer obligations to an assignee, without recourse. If delegated, the assignee, and not WMG, will be sole obligor to card owner. Purchase, use or acceptance of card constitutes acceptance of these terms. Terms may change at any time without notice.

The face value of a WMG Gift Card/ eGift Card is in US Dollars.

You must surrender a WMG Gift Card/ eGift Card to a Participating Spa/Wellness Facility when You redeem the WMG Gift Card/ eGift Card for services and/ or products at the Participating Spa/Wellness Facility.

WMG is an independent company and is not affiliated with or related to, in any way, any Participating Spa/Wellness Facility.

WMG (including, without limitation, its officers, directors, employees, agents, affiliates, and permitted assigns) shall not be liable to You for any and all claims or actions (whether or not groundless), liabilities, damages, costs and expenses (including, without limitation, court costs and reasonable attorneys' fees), arising out of or in connection with (i) any negligent act or omission or willful misconduct of a Participating Spa/Wellness Facility, or its directors, officers, employees, agents, or representatives; (ii) the provision of services, treatments, and/ or products, or failure to provide services, treatments, and/ or products, by a Participating Spa/Wellness Facility, or an agent or representative of a Participating Spa/Wellness Facility, to You; and (iii) any action brought by or on behalf of You relating to a Participating Spa/Wellness Facility's wrongful refusal to accept a valid WMG Gift Card/ eGift Card as payment for services, treatments, and/ or products.

All disputes arising between You and WMG, shall be governed, construed, and enforced in accordance with the laws of the State of Florida, without regard to choice of law provisions. You irrevocably consent to the exclusive jurisdiction of the federal and state courts located in Florida with respect to any matter relating hereto, and hereby waive the defense of forum non conveniens to any such action.

WMG shall be excused from liability for any failure to perform any obligations stated herein where such failure results from delays caused by acts of God, fires, floods, strikes, work stoppages, controls or regulations of federal, states, or local governments, or other causes beyond its reasonable control.

WMG will only ship its Gift Cards to the US and Canada. WMG will only email its eGift Cards to the US and Canada.

Terms for Gift Card promotions in which WMG notes or promotes monetary charitable donations tied to dollars earned through the use of a specific discount code: WMG will donate a lump sum not to exceed the maximum amount of $1,500 to the noted charity(s).

WMG makes no warrantee regarding any goods or services you may receive in connection with the use of the card.

WMG assumes no responsibility and shall not be liable for any injury, loss, or damage of any type or nature which arises out of the use of the card and/ or the performance of any third party provider.

Card value is in US dollars.

Card cannot be returned for any reason.

WMG reserves the right to modify these Terms and Conditions without prior notice.
